Terms of Use

Effective Date: July 2025

Bluesol Cloud (hereinafter referred to as “Bluesol Cloud”, “we”, “us”, or “our”) provides server solutions to clients worldwide. By using our services, you agree to comply with and be bound by the following Terms of Service, Acceptable Use Policy, and Fair Usage Policy (collectively, the “Agreement”).

It is your responsibility to read and understand these terms before using our services.


1. Other Policies and Agreements

Use of Bluesol Cloud services is also governed by the following policies, which are incorporated into this Agreement by reference:

  • Privacy Policy
  • Acceptable Use Policy (AUP)
  • Fair Usage Policy (FUP)

By using our services, you agree to all applicable policies.


2. Acceptable Use Policy (AUP)

Bluesol Cloud reserves the right to refuse, suspend, or terminate service to anyone, at any time, for any reason, with or without notice.

Any material that is deemed by Bluesol Cloud to be illegal, abusive, threatening, obscene, or prohibited is strictly forbidden and may be removed immediately. Failure to respond to abuse-related inquiries within 48 hours may result in suspension or termination of services. No refunds will be provided.

You agree to use only licensed and legally obtained software on Bluesol Cloud servers. Unauthorized or illegal software usage may result in immediate service suspension or termination.


2.1 Prohibited Content and Activities

The following activities are strictly prohibited and will result in immediate suspension or termination without notice:

  • Child pornography or any content involving harm or exploitation of minors (including perceived or simulated content such as “Lolita”). Such violations will be reported to appropriate law enforcement authorities.
  • Human trafficking, prostitution, escort services, or any related content.
  • Malware, phishing, hacking, brute-force attacks, port scanning, IP scanning, DDoS tools, botnets, spam bots, mail bombers, or similar activities.
  • Pirated software, warez, ROMs, cracks, keygens, illegal downloads, or instructions for such activities.
  • Ponzi schemes, pyramid schemes, HYIPs, prime bank programs, illegal financial services, or unregulated investment schemes.
  • Cryptocurrency mining (unless explicitly approved in writing).
  • Gambling, lottery systems, or betting platforms (unless legally authorized and approved).
  • Proxy services, anonymizers, bulk SMS gateways, or mass mailing platforms.
  • Streaming or broadcasting copyrighted content without proper authorization.
  • Courier or logistics platforms without valid company registration and government-issued identity verification.
  • Any website or service promoting illegal activities or linking to such services.

No refunds will be issued for violations.


2.2 Domain & Regional Restrictions

  • Use of free domains such as .tk, .ga, .ml, .cf, or similar is prohibited without prior approval from our abuse/security team.
  • Services associated with sanctioned regions or countries (including but not limited to Iran, Cuba, and Syria) are not allowed in compliance with U.S. export control regulations.

3. Server Resource Usage

Each server plan is allocated specific resources (CPU, RAM, Disk, IO, Network, etc.) as per the purchased plan.

  • Excessive or abusive resource usage impacting network stability or other customers may result in suspension.
  • Bluesol Cloud reserves the right to impose limitations or recommend plan upgrades where required.
  • Abuse-related suspensions are non-refundable.

4. Uptime Disclaimer

Bluesol Cloud does not guarantee 100% uptime.

Uptime may be affected by:

  • Scheduled maintenance
  • Software updates
  • Hardware failures
  • Cyberattacks
  • Network issues
  • Force majeure events (natural disasters, government actions, war, etc.)

Firewall blocks due to unauthorized access attempts or excessive connections are not covered under uptime considerations.

Bluesol Cloud is not responsible for failures caused by third-party services.


5. Mailing & Spam Policy

Bluesol Cloud maintains a zero-tolerance spam policy.

  • Sending unsolicited emails, bulk emails, or spam is strictly prohibited.
  • Any server found involved in spam activity or IP blacklisting will be suspended or terminated immediately.
  • No refunds will be issued for spam-related actions.

6. Billing and Refund Policy

6.1 Payments

We offer Monthly, Quarterly, Semi-Annual, Annual, Bi-Annual, and Triennial billing cycles depending on the server plan.

Accepted payment methods include:

  • Credit/Debit Cards (Indian & International)
  • Net Banking
  • UPI, IMPS, RTGS, NEFT

There is no minimum contract period unless specified.


6.2 Refund Policy

  • VPS, Dedicated Servers, Licenses, and Domains are non-refundable.
  • A 48-hour money-back guarantee applies only if the service does not meet advertised specifications due to hardware or network issues.
  • Refunds are not applicable for abuse, policy violations, or misuse.
  • Payment gateway or bank-related failed/double transactions will be refunded within 7–8 working days.

7. Late Payments

  • Services are suspended 1 day after the due date.
  • Services are terminated 30 days after the due date.
  • A late fee of 10% (based on default currency exchange rate) will be applied.
  • Bluesol Cloud is not responsible for data loss after suspension or termination.

8. Server Security Responsibility

You are fully responsible for:

  • Server security
  • Installed software
  • Application vulnerabilities
  • Data protection and compliance

Bluesol Cloud is not responsible for data loss caused by misconfiguration, hacking, or user negligence.


9. Backups and Data Loss

Backup services, if provided, are courtesy-based only and not guaranteed.

  • Customers must maintain their own backups.
  • Bluesol Cloud is not liable for incomplete, missing, or corrupted backups.
  • Backup restoration (if available) may incur additional fees.

10. Cancellation & Termination

Bluesol Cloud reserves the right to suspend or terminate any service with or without notice for:

  • TOS/AUP/FUP violations
  • Abuse complaints
  • Misbehavior toward support staff
  • Illegal activities

No refunds will be provided. Data recovery may involve additional charges.


11. Coupons & Promotions

  • Coupons are valid for first-time customers only.
  • Coupon abuse may result in service suspension or termination.
  • Discounts cannot be reused for the same domain or customer identity.

12. Software License Policy

Any software licenses purchased from Bluesol Cloud:

  • Must be used only on Bluesol Cloud servers
  • Cannot be transferred or reused elsewhere
  • Violation will result in license termination without refund

13. Jurisdiction

This Agreement shall be governed by the laws of the Republic of India.
Any disputes shall fall under the exclusive jurisdiction of Indore, Madhya Pradesh, India.


14. Disclaimer

Bluesol Cloud shall not be liable for any direct or indirect damages, including loss of data, revenue, or business.

All services are provided “as is” and “as available”, without warranties of any kind.

Bluesol Cloud reserves the right to modify these Terms, pricing, or policies at any time without prior notice. Continued use of services constitutes acceptance of updated terms.
